When Yale University announced in 1965 that it had acquired a pre-Columbian map of the known world showing Viking adventures to North America, the case for the map’s authenticity seemed solid. After all, three renowned experts in medieval documents had assessed the map for Yale, taking nearly seven years to prepare what was to be the definitive defense, a weighty book titled The Vinland Map and the Tartar Relation…. as soon as Yale unveiled the map other scholars began voicing doubt.
Since then Yale, to its credit, has spearheaded intensive scientific study of the map, much of which has put its authenticity in question.

The second part provides individuals with a new right to receive a written “access report” that describes uses and disclosures of their PHI [personal health informaiton] made through an “electronic designated record set.” This new access report would include information on a covered entity’s workforce members who have accessed information and would apply to information in an electronic designated record set, not only information in an electronic health record, as required by HITECH.

Sandals Resorts International Ltd. attempted to force Google to turn over extensive information about the sender of an allegedly libelous e-mail criticizing Sandal’s treatment of native Jamaicans. Sandals operates resorts in the Caribbean.
Yesterday, Sandal’s demand was denied by the New York State Supreme Court:
in a decision that grapples with the nature of libel claims in the Internet age.
A unanimous panel … ruled in Sandals Resorts v. Google, that the online post, considered in its entirety, constituted an expression of opinion.
The decision, written by Justice David B. Saxe, points out that readers generally give statements in private e-mails, blogs and other online media less credence than statements in traditional media… and courts must adjust their standards for libel accordingly.
Judge Saxe quoted case law to that effect. (55 NY L Sch L Rev 333, 335, 2010/11). He emphasized that this was not intended to make acceptable any and all slanderous or damaging email content, whether targeting individuals or companies.
[This is] in no way intended to immunize e-mails [whose] focus and purpose are to disseminate injurious falsehoods about their subjects.” However, he said the court should protect against business interests who use subpoenas to “enlist the help of [Internet service providers] via court orders to silence their online critics [which] threatens to stifle the free exchange of ideas” (43 J Marshall L Rev 1, 15 [Fall 2009]).
